These terms and conditions (“Terms”) govern the use of the e-commerce website (“Site”) operated by Ucon Acrobatics (“Company”) for customers in the European Union (“EU”). By using the Site, you accept these Terms and agree to be bound by them. If you do not agree to these Terms, do not use the Site.

Product Information

The Company strives to provide accurate and up-to-date product information, including descriptions, pricing, and availability. However, the Company does not guarantee the accuracy, completeness, or timeliness of this information. The Company reserves the right to change or update product information at any time without prior notice.

Ordering and Payment

By placing an order on the Site, you are making an offer to purchase goods or services subject to these Terms. The Company reserves the right to accept or reject any offer at its sole discretion. The Company reserves the rights for print errors, changes in prices, missing and delayed deliveries and sold-out items. We currently accept payments by Credit Card (Visa & Master Card), PayPal, Sofort, Google Pay and Apple Pay. Amex and Discover cards are supported through the Paypal guest or member checkout.

Privacy and Security

The Company is committed to protecting customer privacy and security. You can safely use your credit card on our webshop. Our payment system requires 3D Secure – a worldwide security standard verified by Visa and Mastercard.

If your card is flagged as not 3D Secure, or if you’re having issues with the 3D Secure data not being accepted  (Verified by Visa/Mastercard Secure, etc.), it is best to contact your bank to confirm if there is an issue and to make sure your card is 3D Secure.

Intellectual Property

The Site and all its contents, including text, graphics, logos, and images, are the property of the Company and are protected by copyright and other intellectual property laws. Customers may not use any Site content without the express written consent of the Company.

Taxes

All prices on ucon-acrobatics.com are including the applicable VAT tax rate for your country. Please note that customers outside the EU may be subject to import duties and taxes, which are charged once the product reaches your country of destination. All such charges are your responsibility. Ucon Acrobatics has no control over additional charges in relation to customs clearance. If you refuse the package for this reason, customs authorities may charge Ucon Acrobatics an administration fee, and this fee will be deducted from the requested refund amount. You may check with your local customs officials or post office for more information regarding importation taxes/duties that may be applicable to your online order. 

Returns

In addition to your statutory right of withdrawal, we grant you a voluntary return period of 90 days from the date you receive your order.

Returns can be conveniently registered through our returns portal. The returned items must be intact and in original packaging with hangtags. We reserve the right to deduct depreciation from the return amount if the product is not in its original condition. Please note that you will bear the cost of the returned shipment unless your product is faulty, we do not accept drop-point delivery and we do not accept any returns without  previous return registration.

This voluntary return policy does not affect or limit your statutory right of withdrawal.

The original delivery fee is refunded if the entire order is returned. If your order was shipped via express delivery, the delivery fee will not be refunded unless the product is defective or the wrong product was delivered.

Any product purchased at one of Ucon Acrobatics' partner stores or at another authorized dealer must be returned to the original place of purchase. The return period varies depending on the store.

Right of Withdrawal

Withdrawal Period:

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period shall expire fourteen days after the day on which you, or a third party other than the carrier and indicated by you, acquires physical possession of the goods.

To exercise your right of withdrawal, you must inform us (Ucon Acrobatics GmbH, Gabriel-Max-Str. 16, DE-10245 Berlin) of your decision to withdraw from this contract by means of a clear statement. For this purpose, you may in particular use our returns portal and register your return as a withdrawal. Alternatively, you may notify us of your withdrawal by e-mail or by any other clear means of communication.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal:

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for any supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we receive notice of your withdrawal.

We will carry out such reimbursement using the same payment method as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods. 

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Warranty

Products purchased via our webshop are covered by a 2-year warranty.

If you have received a faulty item, we will offer a replacement of the item or offer you a refund of your purchase.

If you make a claim of your purchase within the 2-year warranty period and we accept the claim, we will offer you a replacement with free shipping.

We will refund your shipping costs for returning the faulty item.

If you have received the wrong product or size, we will pay for the return of the product and send you the correct product.

If the item is out of stock, we will refund the price of the item.

The warranty does not cover regular wear and tear of use, but only production faults.

All products from Ucon Acrobatics purchased from one of our partner store are also covered by a 2-year warranty, but all claims need to be submitted through the store at which the product was purchased. However, if the store is no longer in business, please reach out to our customer service team. Upon issuing a complaint, please note that a proof of purchase is required.

For EU customers, if you think that we have not treated your case in a good way or we have not together reached a final solution, you can as a final doing submit a complaint to the European Commission Online Dispute Resolution at http://ec.europa.eu/odr.

Shipping

All orders are shipped during courier's business hours. You will receive an e-mail with shipping information when your package is on the way. If you have not received your order within 14 business days after receiving the shipping information, it is your responsibility to contact Ucon Acrobatics. Once you have received the package, you should inspect the goods. If the package and/or contents are damaged, please immediately contact our Customer Service.

If you are not able to pick up your delivery as agreed, we charge the original shipping fee. The fee will be deducted from your refund.

International Shipping

Please note that you may incur customs duties and taxes on the items you purchase, and these fees are not charged or calculated by Ucon Acrobatics. Customers are responsible for all import taxes, customs, tariffs, excises and other governmental fees associated with their merchandise. Such customs fees, if applicable, are generally paid directly to your national government or postal service at the time of delivery. Ucon Acrobatics has no involvement in foreign customs policies and has no ability to predict possible customs fees for merchandise sent outside the EU. In the case of returned shipments, the Customer is responsible for any and all additional shipping fees and return fees assessed. All orders are sent from Germany. Shipping to some countries is subject to a shipping cost, this will display vividly upon checkout of your purchase.

Promotion

Our offers are only available for a limited period while supplies last. Ucon Acrobatics reserves the right to stop these offers without prior notice.

When returning a product that was purchased within a multi-buy or promotional offer, those additional items must also be returned. If the items are not returned, the value of the items will be deducted from the credit.

Governing Law and Jurisdiction

These Terms are governed by the laws of Germany, without regard to its conflict of laws principles. Any disputes arising from the use of the Site or the purchase of goods or services shall be subject to the exclusive jurisdiction of the courts of Germany.

Changes to Terms

The Company reserves the right to modify these Terms at any time without prior notice. Customers are responsible for reviewing these Terms regularly to ensure their continued compliance.
